Welcome to PLAYER, a platform operated by PLAYERAPP LTD. By accessing or using the PLAYER website, mobile app, or services (collectively, the “Platform”), you agree to comply with and be bound by these Terms and Conditions. Please read them carefully before using the Platform.

If you do not agree to these Terms and Conditions, you must not use the Platform.

1. DEFINITION

  • "Platform" refers to the PLAYER website, mobile apps, and associated services.

  • "User" refers to any individual who registers or interacts with the Platform, including football players, scouts, coaches, agents, and other visitors.

  • "Content" refers to any material (such as photos, videos, text, or data) that users upload to or share via the Platform.

2. ELIGIBILITY

PLAYER is intended for individuals aged 16 years or older. By creating an account or using the Platform, you confirm that you are at least 16 years old.

We do not knowingly collect or process personal data from anyone under this age. If we become aware that someone under 16 has registered or shared personal data, we will promptly delete the account and remove their information from our systems.

3. USER ACCOUNTS

To access certain features of the Platform, you may be required to create an account. You agree to provide accurate and complete information when registering, and to keep this information up to date. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.

4. Use OF THE PLATFORM

By using the Platform, you agree to:

  • Only use the Platform for lawful purposes, in compliance with all applicable laws and regulations.

  • Refrain from uploading, posting, or sharing any content that is illegal, offensive, defamatory, or infringes on the rights of others.

  • Avoid impersonating other individuals or entities, and do not misrepresent your affiliation with any organisation.

We reserve the right to suspend or terminate your account at our discretion if we believe you are violating these Terms and Conditions or engaging in any inappropriate behaviour.

5. CONTENT

You may upload or share content on the Platform, including photos, videos, text, or other materials (“Content”). Player profiles and related Content may be shared outside the Platform for recruitment and visibility purposes. These links are optional and controlled by you in your account settings, or by emailing us at hello@playerapp.co, and may allow non-registered users to view your profile for recruitment or promotional purposes.

By uploading Content, you grant PLAYERAPP LTD, its officers, employees, contractors, service providers, and affiliates a non-exclusive, worldwide, royalty-free, sublicensable, and transferable licence to host, use, modify, reproduce, and distribute your Content for the purpose of operating, improving, and promoting the Platform. You retain ownership of your Content. This licence ends when you delete your Content or close your account, except to the extent copies are required to be retained for legitimate business or legal reasons.

You are responsible for the Content you share and must ensure that you have the necessary rights and permissions to post it.

6. COMMUNICATION WITH USERS

By registering an account or providing your contact information, you agree that PLAYERAPP LTD, its officers, employees, contractors, service providers, and affiliates may contact you using the details you have provided, including by email, phone, in-app messages, social-media platforms, or other reasonable methods related to the operation and improvement of the Platform.

Such communications include but are not limited to Platform updates, account or security notifications, user engagement, recruitment opportunities relevant to your role (for example, as a player, coach, scout, or agent), and other messages necessary for providing or enhancing the Platform experience.

Promotional or marketing communications may be sent in accordance with applicable data-protection and electronic communications laws. You may opt out of marketing communications at any time using the unsubscribe link in our emails or by contacting us at hello@playerapp.co.

Essential service messages (such as account security or functional updates) cannot be opted out of.

7. DATA PRIVACY

Your privacy is important to us. For detailed information on how we collect, use, and protect your personal data, please refer to our Privacy Policy.

By using the Platform, you agree to the collection and use of your personal data in accordance with our Privacy Policy.

PLAYERAPP LTD operates internationally. While our primary servers are located in the United Kingdom, certain trusted service providers (such as AWS, Google, and Firebase) may process data in other countries, including the United States.

All such transfers are protected by appropriate safeguards designed to ensure your information remains secure and is treated in accordance with applicable data-protection laws and internationally recognised standards.

8. INTELLECTUAL PROPERTY

All content and materials available on the Platform, including but not limited to text, images, logos, trademarks, and software, are the property of PLAYERAPP LTD or its licensors, and are protected by intellectual property laws. You are granted a limited, non-exclusive, and non-transferable right to access and use the Platform for personal, non-commercial use.

You may not copy, modify, distribute, or create derivative works from any content or materials on the Platform without prior written consent from PLAYERAPP LTD.

9. LIMITATION OF LIABILITY

The Platform is provided on an “as is” and “as available” basis. PLAYERAPP LTD, its officers, employees, contractors, service providers, and affiliates make no warranties, express or implied, regarding the Platform’s operation, availability, accuracy, or fitness for any particular purpose.

To the fullest extent permitted by law, PLAYERAPP LTD and the above parties shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to:

– loss of data or content;

– loss of business opportunities or earnings; or

– damage to your devices or systems due to software bugs, viruses, or malfunctions.

PLAYERAPP LTD’s total aggregate liability for any claim arising from or relating to your use of the Platform will not exceed the greater of (a) the total amount you have paid (if any) to use the Platform in the 12 months preceding the claim, or (b) £10.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation, or for any obligations we have under applicable data-protection laws

10. USER CONDUCT

You agree not to:

  • Upload, post, or share content that is defamatory, abusive, obscene, or otherwise harmful.

  • Engage in harassment, bullying, or abusive behavior towards other users.

  • Impersonate any person or entity, or falsely represent your affiliation with a person or entity.

  • Interfere with or disrupt the operation of the Platform, including through the use of viruses, bots, or any other means designed to impair its functionality.

  • Attempt to access or use another user’s account without permission.

We reserve the right to remove any content or suspend or terminate your account if we believe you are in breach of these terms, or if your actions are harmful to the Platform or its users.

11. RECRUITMENT AND SCOUTING

If you are a football player, coach, scout, or agent, you acknowledge that the Platform may facilitate recruitment or scouting opportunities. While PLAYERAPP LTD provides the platform for these opportunities, we do not guarantee any specific outcomes, such as trials, contracts, or offers. Any interactions or agreements made through the Platform are strictly between you and the other party involved, and PLAYERAPP LTD bears no responsibility for the outcome of such arrangements.

12. PROFILE AND VIDEO SHARING

The Platform allows you to share your player profile and video content with scouts, agents, coaches, and other relevant third parties for recruitment and visibility purposes. These links provide access only to the specific content you choose to share and may be viewed by non-registered users solely via the issued link for recruitment and evaluation purposes.

By enabling sharing, you acknowledge and consent to your selected content being viewable outside the Platform in accordance with this clause and our Privacy Policy. You may disable sharing at any time in your account settings, or by emailing us at hello@playerapp.co, after which previously issued links will no longer provide access.

You must not publicly post or distribute shared links in a way that is inconsistent with recruitment and evaluation purposes. PLAYERAPP LTD, its officers, employees, contractors, service providers, and affiliates reserve the right to revoke or disable any links that are misused or that compromise user privacy or platform security.

13. THIRD-PARTY LINKS AND SERVICES

The Platform may contain links to third-party websites or services. These links are provided for your convenience only, and PLAYERAPP LTD does not endorse or assume any responsibility for the content or practices of any third-party websites or services. You access such third-party links at your own risk, and it is your responsibility to review the terms and conditions and privacy policies of any third-party websites or services you visit.

14. TERMINATION

You may terminate your account at any time by contacting us at hello@playerapp.co. Upon termination, your right to use the Platform will cease immediately. We reserve the right to suspend or terminate your account at our discretion if we believe you have violated these Terms and Conditions.

15. MODIFICATION TO THE PLATFORM AND TERMS

PLAYERAPP LTD reserves the right to modify or discontinue the Platform, or to change these Terms and Conditions at any time. Significant changes to the Terms and Conditions will be notified via email or in-app notification, and the updated Terms will take effect upon posting. When we make changes, we will update the “Last Updated” date at the top of these Terms. It is your responsibility to review these Terms regularly. By continuing to use the Platform after any changes, you agree to be bound by the revised Terms.

16. GOVERNING LAW

These Terms and Conditions, and any dispute arising from your use of the Platform, are governed by the laws of England and Wales. By using the Platform, you agree that any disputes will be resolved in the courts of England and Wales.

While these Terms are governed by the laws of England and Wales, users outside the United Kingdom may have additional rights under their local privacy legislation. Nothing in these Terms limits those rights.
